1. Who we are and what these terms cover

Amber Loop is provided by ESINYA LTD (“Esinya”, “we”, “us”), registered in England and Wales, company number 17433260, registered office 100 St. Marys Drive, Crawley, England, RH10 3BQ, United Kingdom. Contact: privacy@esinya.com.

These terms cover the Amber Loop app at app.amberloophq.com, the Amber Loop apps and this website. By creating an account or using Amber Loop you accept them. If you use Amber Loop for an organisation, you accept them for that organisation and confirm you are allowed to.

Amber Loop is a professional tool for creators, educators and businesses. If you are a consumer, you keep every right the law where you live gives you; nothing in these terms takes those rights away.

2. Your account

  • You must be 18 or over.
  • Use an email address you control, or your Google account. You may be asked to confirm your email before some features open — for example, opening your clips.
  • One person, one account. Do not share your sign-in. Anyone who can open your email can sign in to Amber Loop, so keep your email and devices secure.
  • Tell us at once if you think someone else has used your account.

3. Workspaces and teams

Your work lives in a workspace. The workspace’s owners and administrators decide who belongs to it, what each person can do, and what stays or is deleted. If you work in someone else’s workspace, what you create there belongs to that workspace and stays there if you leave.

4. Early access and founding credits

  • Amber Loop is in early access: features may change and some are unfinished.
  • Founding members receive free credits each month. Credits have no cash value, cannot be transferred or sold, and unused credits do not carry over unless we say so in the app.
  • Free use has limits, for example how many videos can be processed each day. When a limit is reached, the app says so.
  • There is no charge today. If we introduce paid plans, they will come with their own terms, we will tell you first, and nothing will be charged without your explicit agreement.

5. Your content

  • It stays yours. You keep all rights in the videos, text, images and other material you upload.
  • Permission you give us: to host, copy, transcribe, cut, subtitle, translate, transform and show your material to your workspace, to send it to the providers we use, and — when you decide — to the publishing service, only to provide Amber Loop to you. This permission ends when your content is deleted, except for backup copies until they expire.
  • You must have the rights. When you upload a video you confirm that you may use and publish it, including the people, images and music that appear in it. Do not upload material you have no right to use.

6. What Amber Loop makes for you

  • As between you and us, you own the clips, text, images and videos Amber Loop makes for you, and you may use them for any lawful purpose, subject to the rights in your own source material.
  • AI can produce similar results for other people, so we cannot promise that what it makes is unique.
  • AI can be wrong. Names, numbers and claims may be mistaken. Amber Loop flags what it is unsure about, but you must review everything before you publish it.

7. Publishing

  • Nothing is published without your decision. Amber Loop publishes or schedules a post only when you, or someone your workspace allows, chooses to.
  • When you publish through connected accounts, you instruct us to send the post to our publishing service, which delivers it to the platform. You are responsible for following each platform’s rules.
  • Platforms can refuse, delay, remove or change posts. Check the calendar for the status of each post; we are not responsible for what a platform does.

8. Acceptable use

Do not use Amber Loop to:

  • upload or publish anything unlawful, infringing, defamatory, hateful, harassing or deceptive, or anything that sexualises or endangers minors;
  • impersonate anyone, or present AI-made people, voices or events as real in a way that misleads;
  • send spam;
  • break, probe or overload the service, get around its limits, or copy it by automated means;
  • create several accounts to collect free credits, or resell access.

We may remove content, refuse a request, or suspend an account that breaks these rules. Where it is reasonable, we tell you first and give you the chance to fix it.

9. Our part

  • We provide Amber Loop with reasonable skill and care.
  • During early access we may change, add or remove features. We tell you in advance about changes that take away something important you rely on.
  • We work to keep Amber Loop available, but we cannot promise it will always be available or error-free. Keep your own copies of anything important — you can download your clips.

10. Processing on your behalf

For the personal data inside your workspace — including people who appear in your videos — your organisation is the controller and Esinya is the processor. For that data we:

  • process it only to provide Amber Loop as described in these terms and as you instruct through the app;
  • make sure everyone who handles it is bound to confidentiality;
  • protect it with the security measures in section 10 of the Privacy policy;
  • use only the kinds of sub-processors listed in section 6 of the Privacy policy — you authorise them — and tell you before we add or replace one, so you can object;
  • help you respond to requests from the people concerned and meet your own legal duties;
  • tell you without undue delay if a breach affects that data;
  • delete it when you delete it, or when your workspace ends, as set out in the Privacy policy;
  • give you the information you reasonably need to show these duties are met.

You confirm you have a lawful basis for the personal data you put into Amber Loop, including the permission of people who appear in your videos.

11. Amber Loop belongs to us

The Amber Loop software, design, name and logo belong to Esinya. You may use Amber Loop while these terms apply. If you send us suggestions or feedback, we may use them freely and without any obligation to you.

12. Ending

  • You can stop using Amber Loop at any time and ask us to delete your account — see Delete your account.
  • We may suspend or close an account that seriously or repeatedly breaks these terms, or when the law requires us to.
  • We may end early access or Amber Loop itself with at least 30 days’ notice, so you have time to download your work.
  • After an account ends, its data is deleted as the Privacy policy describes.

13. Liability

  • Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else the law does not allow us to limit.
  • We are not liable for loss that was not reasonably foreseeable, for loss of profit, revenue, business, goodwill or opportunity, or for what you publish or what a platform does with it.
  • Our total liability to you in any 12 months is limited to the greater of what you paid us in those 12 months and £100.
  • If you are a consumer, we are responsible for foreseeable loss we cause by breaking these terms or by failing to use reasonable care and skill, and your legal rights as a consumer are not affected.

14. Claims about your content

If you use Amber Loop for a business and someone makes a claim against us because of content you uploaded or published, or because you broke section 8, you will cover our reasonable costs and losses from that claim. We will tell you about the claim promptly and let you take part in handling it.

15. Changes to these terms

We may update these terms. We change the date at the top and tell you about important changes by email or in the app at least 14 days before they apply. If you do not agree, you can stop using Amber Loop and ask us to delete your account.

16. Law and general terms

  • These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer, you also keep the protection of the mandatory law of the country where you live and may bring proceedings there.
  • If a part of these terms cannot be enforced, the rest still applies. If we do not enforce a right straight away, we can still enforce it later.
  • We may transfer these terms to a company that takes over Amber Loop, with the same protections for you. You may not transfer them without our agreement.
  • These terms are published in English and Portuguese with the same meaning. If they differ, the English version prevails, unless the law where you live requires otherwise.
